The Sun reports that Katie, 32, has been advised by her lawyers that it is the earliest possible date that proceedings can get under way.
A date was set during a crisis meeting on Monday at the couple’s Surrey mansion, where they are living in separate wings.
A source told the paper: “Katie is chomping at the bit to file papers but has been told she has to wait until the one-year marker.
“She told Alex she will petition for divorce as soon as possible, which is a week on Thursday. He has agreed. This is one of several significant gestures on his part but he still wants to make sure he gets a good deal.”
Divorce proceedings can only begin 12 months after marriage. The couple wed in Las Vegas on 10 February last year.
Alex is reportedly refusing to leave the marital home until the couple agree on a settlement he is happy with. The source claims that he is refusing to accept any payment which will include him signing a gagging order preventing him from talking about his time with Katie.
The source continues: “He has so far refused to be gagged.
“He’d rather take a small amount financially from the marriage with a view to profit from it in the future.”
